Not sure where you get your writers from but this is laughable. The MCC quote very clearly states that gaining an advantage does not matter and is not to be considered. Your whole conclusion is pinned on the fact that QDK does not gain an advantage. You have completely misinterpreted the law and the quote.

For law 41.5.1 to be considered, the umpires need only satisfy themselves that the fielder wilfully attempted to distract or deceive. It does not matter whether that attempt gained an advantage or was successful. By calling is "clever deception" you have proven that QDK did wilfully attempt to deceive and thus Fakhar should have been not out.
